Whether you’re buying a winter condo, closing on a waterfront home, or handling a commercial transaction, the right piece of real estate is only half the battle. We handle every detail of your closing — from title search to funding — so it closes on time, every time.
Hochberger Law is a Deerfield Beach real estate law firm handling residential and commercial transactions — closings, contracts, title, and deeds — for buyers, sellers, investors, and lenders throughout Broward and Palm Beach counties. Your closing is handled by an attorney from contract to recording.
How we can help
Residential Closings
Full representation for buyers and sellers of single-family homes, condos, townhomes, and waterfront property across the Tri-County area — with clear communication at every step. Paying cash? Here is what to know about a cash purchase.
Commercial Real Estate
Purchases, sales, and leasing of commercial property — office, retail, mixed-use, and investment property — handled with the diligence a significant investment deserves. We review purchase contracts and leases, coordinate due diligence, and close the deal.
Condo & HOA Purchases
Buying into an association means reviewing more than the unit. We order estoppel certificates, track association approval, and help you understand the governing documents. After Florida’s post-Surfside condominium safety laws, we also look at the building’s milestone inspection and reserve study status before you commit.
Title Insurance & Searches
As a member of Attorneys’ Title Fund Services underwriting with Old Republic, we manage the title search and insurance so your ownership is protected. Wondering whose side the title company is on? Read who a title company represents.
Deeds & Property Transfers
Adding or removing a name, moving property into a trust or LLC, or choosing between a warranty deed and a quitclaim deed — we prepare and record deeds correctly. Thinking about an LLC? Start with the tax and mortgage issues of transferring property to an LLC.
Inherited & Trust Property
Selling property after a death means clearing title first. We handle sales of inherited houses and houses held in a trust, including the probate side when it’s needed.
Contract Review & For-Sale-By-Owner
Selling or buying without an agent? We review contracts and guide you through the process so nothing is missed.
How a closing works with us
- Contract. We review the executed contract and calendar every deadline — deposits, inspection, financing, and closing.
- Title search and commitment. We search the title and issue a commitment showing what must be cleared before closing.
- Clearing issues. We order payoff letters, lien searches, and estoppel certificates, and resolve title defects.
- Closing documents. We prepare the deed, closing statement, and supporting documents, and coordinate with the lender.
- Closing and funding. We supervise signing and disburse funds from our trust account.
- Recording and policy. We record the deed and issue your owner’s title insurance policy.
Why an attorney-run closing
Many Florida closings are handled by title agencies with no attorney involved. At Hochberger Law, a licensed Florida attorney reviews your transaction, can answer legal questions as they come up, and can fix problems — a probate issue, an old lien, a missing signature — instead of just flagging them. And because we also practice estate planning and probate, we can handle deals where real estate and estates overlap.
Real estate FAQ
Do I need a real estate attorney in Florida?
Florida doesn’t require one, but an attorney protects your interests in ways a title agent or real estate agent can’t — reviewing the contract, explaining your risks, and resolving title and legal issues before they delay closing.
Who pays for title insurance in Broward and Palm Beach counties?
By local custom, the buyer usually pays for the owner’s title policy in Broward County, while the seller usually pays in Palm Beach County. Custom isn’t law — the contract controls, and it’s negotiable.
What is documentary stamp tax?
Florida charges documentary stamp tax when a deed is recorded — generally 70 cents per $100 of the sale price outside Miami-Dade County. It’s customarily paid by the seller, but the contract can say otherwise.
Can you handle a commercial lease?
Yes. We draft and review commercial leases for landlords and tenants, including rent terms, maintenance and repair obligations, and renewal and assignment rights.
