Should You Put Your Rental Property in an LLC in Florida?

Many Florida landlords wonder whether to hold their rental property in a limited liability company. For the right owner, an LLC offers real protection—but it is not a fit for every situation.

The main benefit: liability protection

If a tenant or visitor is injured and sues, an LLC can keep the claim contained to the property and the business—helping shield your personal home, savings, and other assets. That separation is the number-one reason investors use an LLC.

Important Florida cautions

  • Never put your homestead in an LLC—you would lose Florida’s homestead creditor and tax protections.
  • If the property has a mortgage, transferring it can trigger a due-on-sale clause.
  • The LLC only protects you if you keep it properly maintained and don’t commingle funds.

Is it worth it?

For a non-homestead rental or investment property, an LLC is often worth the modest cost and paperwork. We break down the downsides in our article on the disadvantages of an LLC for rental property. Contact Hochberger Law to set one up correctly.
